Terms of Service
━ GENERAL ━
🫧I retain all rights to the commissioned artwork, which includes but is not limited to the reposting, display, and use of the artwork for my promotion, unless previously otherwise agreed on.
🫧Please note that my artwork and style might change due to improvement. That may affect the quality result and price from time to time.
🫧COMMISSIONS ARE NOT TO BE USED FOR NFT OR AI ART TRAINING PURPOSES.
🫧I have the rights to alter the Terms of Service at any time. New rules will not apply retroactively and won't influence orders started on older terms.
🫧By requesting a commission, the Clients agree to respect my art style, meaning they will not ask to amend the color palette and style of line-art.
━ ARTWORK ━
🫧It will take me 7-14 working days to finish the commission (excluding queue time), depending on the complexity of the work, my schedule, or any other unexpected things. I'm not a fast artist, so please do not ask for rush commissions.
🫧I will only draw on plain/solid colored background. Additional decorations might be added.
🫧I reserve the right to reject, cancel, or stop working on a commission in case of rude/inappropriate behavior, poor communication, breach of the Terms of Service, in case I'm not comfortable with the idea/concept of the request or the Clients provide insufficient reference.
🫧I will share previews with watermark. Non-watermark version will be given to the Clients once the commission is done.
🫧If Clients wish to post the commissioned work, please post the one with my watermark and credit me @daphielorca
━ USE ━
🫧The price listed is for personal commissions only; Clients may use the digital files for PFP/Avatars on social medias, wallpapers, social media banners, giveaway/raffle, etc., as long as there is no profit being made from it. Clients are prohibited from reselling the artwork for redistribution and external projects, i.e.: t-shirts, mugs, public flyers, etc.
🫧Partial commercial commissions for streaming/content use: Clients are allowed to use the art on monetized sites/contents, starting/ending screen on stream, music videos, thumbnails, etc.
🫧Full commercial commissions for merchandise/ads/prints: Clients are allowed to make merch and make a profit with it. Please contact me for further information regarding commercial commissions.
🫧Price can be subject up to a 100% surcharge for any other commercial use (physical merchandising as stated above).
━ PAYMENT AND REFUND ━
🫧 The payment is made via Paypal or VGen. Clients can pay half or full upfront and the remaining half after the sketch is approved.
🫧 All invoices are due within 7 days from receiving them, unless agreed otherwise. Invoices past the due date will be cancelled along with the commission request. The Clients will be notified of this fact.
🫧 After the commission has been paid, no refund can be made, with exceptions including but not limited to:
› While working on the commission, I realize the request is outside of my capability and I will not be able to execute the Clients' idea in the best quality.
› Any of my personal reasons that arise in the middle of working process, preventing me from continuing to work.
━ WORKFLOW ━
🫧After sending the commission request and make confirmation, Clients need to make 50% down payment before I start the sketch. I will not start the sketch before the payment is made.
🫧Clients must have the character design and references ready, as specific as possible.
🫧During sketching process, you may ask for major revisions (except prompt change) without additional fee.
🫧Minor revisions are available during all process without additional fee.
🫧Major revisions after lining process will be charged $5/revision.
» Major revisions: (Not limited to) Character change, pose change, expression change, object change)
» Minor revisions: Color change
🫧Clients are not allowed to use rejected sketches and I'm allowed to use them for future artwork.
🫧Commission cannot be cancelled or refunded after the sketch has been sent.
🫧Clients have the right to ask for work-in-progress updates whenever they need, however it is recommended to check my waitlist to track the order's progress.
🫧Generally, there is no clear estimation on how long will each commission take. Clients will always be notified of the approximate time frame until the next stage.
🫧After Clients satisfied with the commission, I will send the high quality file in PNG format to the Client' email. By doing so, the commission is considered to be closed and any further edits asked by the Clients after this point will be charged.
By accepting and purchasing my commission, you're agreeing to my TOS and rules explained in this page.
Not reading the terms of service is not valid grounds for not abiding by them.
━ HOW TO ORDER ━
🫧 Read and understand all the Terms of Service.
🫧 You can order directly from vgen.co/daphielorca, or contact me through Twitter / Discord.
🫧 Make sure you have all the references ready.
🫧 Let me know which type of commission you'd like to get. After all references are sent, I will send you the invoice, and you can make 50% or full upfront payment to one of the MOP destinations.
🫧 After the payment is made, I will start the sketch. The remaining payment will be done after base colors.
🫧 Please proceed the payment in maximum of 2 x 24 hours. If you fail to make payment, I will consider the commission is cancelled.
🫧 To avoid the aforementioned situation, should you need to hold the commission due to an emergency, please be clear with the reasoning and set your own payment deadline.
